Wage Garnishments
The IRS and State begin to seize assets when their written attempts to collect past due tax debt are unsuccessful. This can be in the form of wage garnishment, account receivable garnishment, bank levies, seizing real estate property to sell at auction, assume title on vehicles, seizing business assets to sell at auction, and anything else they can get their hands on to forcefully make you pay your past due tax liability.
A Wage Garnishment is an action taken by the IRS and/or State whereby a portion of your pay check or your entire pay checks are forcefully handed over to the IRS or State to pay your past due tax liabilities. This occurs when the IRS or State feels you have repeatedly ignored their requests to pay the debt. By law, your employer must abide by the request to relinquish your earnings when they are served with a Notice of Levy on your Wages.
A W2 employee is garnished a significant portion of their wages and this remains in effect indefinitely on every pay check until your debt is paid in full.
A 1099 subcontractor that is levied on their earnings is garnished their entire pay check. A 1099 Subcontractor may work for several different companies and each one of their account receivables will be served this type of levy on their earnings.
